HOW ATTORNEY HANKS CAN HELP YOU

Custody, visitation, primary residence, and secondary residential responsibility no longer exist in Florida.  In all Florida courts including St. Petersburg, Clearwater, Tampa, Bradenton and Pasco, the parties are required to enter into a parenting plan, which spells out the terms of their co-parenting. The time each child will spend with each parent can vary greatly.

Child support is calculated by applying the parties' monthly income after taxes and insurance, and the costs of the child's health insurance and child care, and the number of overnights spent with each parent, to the State's guidelines.  Getting the numbers right is crucial to an accurate calculation.

Attorney Hanks will also:

Discuss and evaluate the 20 different, statutory factors for parental responsibility and time-sharing, as the factors relate to your specific case.

Recommend and develop a specific parenting plan that considers all relevant factors to maximize your chance of success.

Correctly determine incomes by subpoenaing, if necessary, employment records of the other party, for the correct calculation of child support through the use of advanced software.

Divorce is rarely simple or uncontested.  While the parties generally agree on dissolving their marriage, they have different opinions on how to split their property, who pays for what debt, and whether one party should pay the other alimony/spousal support or legal fees.

As a practicing, family law attorney for the past twenty years, and a member of the Family Law Section of the Florida Bar, Attorney Hanks will:

Advise as to whether certain assets and liabilities are marital (subject to being divided between you and your spouse), or non-marital (your spouse is not entitled to a share), pursuant to the most recent caselaw.

Identify and value the marital assets and liabilities with all tools available through the Florida Rules of Family Procedure, recommending the consultation of experts when necessary.

Devise an equitable distribution plan for the split of all marital assets and liabilities, or evaluate the opposition's plan for distribution, both with the use of advanced software.

Evaluate the probability of an award of alimony, on  whether temporary, durational, bridge-the-gap, lump sum or permanent, via the application of current caselaw to the particular facts of your case.

Advance your case from the intiial pleading and service of process, through mandatory disclosure stage, and mediation, often for one set fee.

If your case does not settle at mediation, engaging in advanced discovery techniques and retention of experts, in complete preparation for your trial.

Frequently, Clients involved in a divorce, will have questions about bankruptcy, especially when their debts exceed their assets.  With Attorney Hanks, P.A., you won't need a second lawyer for those questions or to handle your bankruptcy.  Attorney Hanks has been appearing in bankruptcy court for over 20 years.

Domestic Violence Injunctions (Temporary Restraining Orders):

Parties often seek injunctions that protect one party and restrict another.  Often within a 10 minute hearing, someone who needs one will be denied; or an injunction with no legal basis will be granted.

Attorney Hanks will:

Discuss and develop your case through your own testimony and the use of any witnesses.

Devise effective direct & cross examinations and present your evidence & argument in Court to get you the justice you deserve.

And if an arrest for domestic battery led your spouse to seek a restraining order or injunction, or if you have been charged with violating that restraining order or injunction, Attorney Hanks can handle and defend your criminal charge with his 28 years of criminal law experience.  One attorney for all matters.  Justice Served.

Attorney Hanks will also help in cases involving Paternity, Relocation, Modification of Custody or Child Support, Contempt of Court, Step-Parent and Relative Adoptions, Recognition of Foreign Adoptions,  and Dependency/DCF actions, from Saint Petersburg, Clearwater, Tampa, New Port Richey, Bradenton, Sarasota, and all of Tampa Bay.

What former clients have posted:

My ex husband was a criminal while we were married and Mark got us out of plenty of binds. I was always very satisfied with Mark's services, so I went back to Attorney Hanks for divorcing my ex's as well. There is NO divorce too complicated for Mark. My ex husband was violent, he endangered our kids, he attempted to hide the business's assets to lower child and spousal support. None of it was too much for this attorney to handle. Thanks a million Mark.

From the time that I stepped into Mark’s office, I knew he was the right person to represent me in my divorce. He was honest, knowledgeable and candid throughout the whole process. He is exactly what I was looking for in an attorney.  Many thanks to Mark Hanks!  I would recommend Mark Hanks to friends and family!
